Privacy Policy of 1AV

1Aviation Groundhandling Services, Corp. (1AV) is a company that provides ground handling services for all types of aircraft that transports passengers or cargo within or outside of the Philippines. In delivering these services, it acts as a Personal Information Controller (PIC) and as a Personal Information Processor (PIP) for the Personal Information (PI) of its employees, customers, and partners (collectively, Data Subjects). 1AV secures and protects the PI in accordance with the Data Privacy Act (DPA) of 2012 and its Implementing Rules and Regulations (IRR).

We have written this Privacy Policy to inform our Data Subjects how we take care of their personal information and privacy. When needed, we will change this policy from time to time to better protect the personal information and privacy of our Data Subjects.

Our Purpose for Processing Your Personal Information

1AV processes your personal information for the following purposes:

  (a) providing administrative services to our employees;

  (b) responding to your concerns;

  (c) processing the job application of individuals who want to join 1AV;

  (d) improving how we deliver our services; and

  (e) performing ground handling services including and not limited to:

     1. maintenance of aircraft and ground support equipment;

     2. ramp handling;

     3. aircraft cleaning;

     4. catering;

     5. cargo receiving, loading, unloading, weighing, gauging, measuring, storing goods, wares, and consolidation of merchandise of all kinds;

     6. documentation and check-in and other counter services for commercial airline passengers including airport bus services;

     7. security services to prevent theft or unauthorized use of, injury or damage to persons, cargoes, carriers, or passenger properties;

     8. importation of machineries, equipment, and spare parts needed to perform ground handling services; and

     9. all acts necessary, convenient, and pertinent to ground handling services.

How We Respect Your Preferences and Data Privacy Rights

According to the Philippine Data Privacy Act (DPA) of 2012, you as our Data Subject have privacy rights in relation to your personal information that we process. These rights and how you can exercise them are set out below.

Right to be Informed. We value your right as our Data Subject to be informed about whether your personal information shall be, are being, or have been processed, including the existence of automated decision-making and profiling. We do this by presenting a privacy notice to you for any data processing activity that we will do.

Right to Object. As our Data Subject, you can object to our processing of your personal information or to any automated decision-making based on your personal information. You may also request to suspend such processing. The processing however should be based on your consent or our legitimate interest. Your right to object shall be subject to processing pursuant to a subpoena, contractual purposes, or a result of a legal obligation. You can exercise this right by sending an email to DPO@1av.com.ph 

Right to Access. Upon sending a request to us, you as our Data Subject may access your personal information or inquire about how your personal information is being processed. You can exercise this right by sending an email to DPO@1av.com.ph

When applicable, the following instances may limit your right to access:

  (a) Publicly available information

  (b) Repeated requests

  (c) Requests which will entail disproportionate effort

  (d) Consideration of the safety of the data subject

Right to Rectification. Subject to applicable laws and regulations, we acknowledge your right as our Data Subject to dispute the inaccuracy or error in your personal information. You may request to correct or complete the same within a reasonable period of time by sending an email to DPO@1av.com.ph

Right to Erasure or Blocking. We may act upon your request as our Data Subject for the suspension, withdrawal, blocking, removal, or destruction of your personal information in any of the following situations:

  (a) Your personal information is:

     · incomplete, outdated, false, or unlawfully obtained;

     · used for an unauthorized purpose;

     · no longer necessary for the purpose(s) for which they were collected; or

     · concerns private information that is prejudicial to you, unless justified by freedom of speech, of expression, or of the press, or otherwise authorized (in such case, 1AV may deny your request).

  (b) You object to the processing, and there are no other applicable lawful criteria for processing;

  (c) The processing is unlawful; or

  (d) Your rights as our Data Subject are violated.

Right to Data Portability. We may provide, upon request, a copy of your personal information as our Data Subject. You can exercise this right by sending an email to DPO@1av.com.ph

Right to Damages. As our Data Subject, you may be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal information, taking into account any violation of your rights and freedoms as our Data Subject. Subject to lawful defenses on our favor, we shall comply with the relevant provisions of the Philippine Data Privacy Act of 2012 regarding compensation in the event of a final judgment that you suffered damages due to false, unlawfully obtained, or unauthorized use of personal information.

We understand that your rights as our Data Subject apply to your personal information. If you are exercising on behalf of another Data Subject, we will require a signed letter of authority from the relevant Data Subject. In addition, we will conduct strict verification and validation procedures for the protection of the Data Subjects.

You will not have to pay a fee to access your personal information or to exercise any of the other rights. However, we may charge a reasonable fee if your request is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.

When do we collect Personal Information

1AV collects personal information whenever you avail of our services, whether they are provided directly by us or by other companies or agents acting on our behalf. 1AV also collects personal information when we assist you in your flight, when you email us or contact us on social media, when you inquire about our services or job openings, or when you make us a request.

We may also collect your publicly available information through social media or public directories.

What Personal Information We Process

1AV processes the following personal information:

  (a) all personal information required for employment with us;

  (b) all personal information relevant to address your concerns; and

  (c) all personal information needed for doing business with us related to ground handling services.

Depending on the situation, we may process your name, contact details, and sensitive information such as Philippine government-issued identification, among others.

How We Protect Your Personal Information

1AV protects your personal information in the following manner:

  · Obtaining your consent for the following:

     o Before using them for your job application or your concerns

     o Before sharing them with other parties

     o Before using them for purposes other than those listed in this Privacy Policy

  · Limiting the personal information based on what is needed for the specific purpose

  · Prohibiting sharing your personal information unless a legitimate basis is established

  · Using technical measures to prevent unauthorized access to your personal information

  · Implementing physical security where needed

  · Applying organizational measures including and not limited to the following:

     o Training our personnel on the appropriate way to process your personal information

     o Executing legal instruments where needed

With Whom We Share Your Personal Information

We may share your personal information with others for the following purposes:

  · With government agencies when they have legitimate basis to obtain your personal information

  · With regulators when they require us to do so

  · With other parties when fulfilling our purposes as specified in this Privacy Policy, subject to legal instruments

How Long We Keep Your Personal Information

We retain your personal information only for as long as necessary for the purpose for which that data was collected and to the extent required by applicable law. 

How Do We Dispose of Your Personal Information

When we no longer need your personal information, we will remove your personal information from our systems. Any physical records will be disposed of through shredding, while digital files will be anonymized, all in accordance with our Data Retention and Disposal policy and procedures.
